For general personal injury claims, the statute of limitations (time limit imposed by law) is two years from the date of injury in Colorado. This time limit applies to slip and fall accidents, dog bites, and other types of personal injury. If you are bringing a claim against a city or county or the State of Colorado, you only have 180 days in which to file.
Motor vehicle accidents are an exception to this rule, with a longer time limit. The statute of limitations for a car accident, truck accident, motorcycle accident, or other types of traffic collisions is three years from the date of injury. One possible exception to the statute of limitations is the discovery rule. This applies when it is not possible or reasonable for the injured person to know the cause of injury – or even that an injury has occurred – until after (sometimes long after) the date of the injury. An example of when the discovery rule may apply is lung cancer that has taken decades to develop after asbestos exposure.
