Call the Tenge Law Firm, LLC After a Serious Back Injury

A dislocated or herniated disc in your spinal column is not only painful, but may require extensive medical treatment - even surgery - to recover from. While herniated discs can occur naturally over time, they are often caused by accidents that injure the spinal cord. It’s fortunate that medical treatment is available for herniated discs, but it is still important to hold the at-fault parties accountable for their actions.

Whether you were injured in a vehicle collision, a slip and fall, or another type of accident, you deserve compensation for your suffering.

If you or a loved one has suffered a serious spinal cord injury, you may feel powerless. However, you have a number of options available to you. Before you agree to any insurance payout, make sure you have an attorney to represent you and see that your rights are protected.

Call the Tenge Law Firm, LLC at (303) 502-5587 and put a top Denver trial lawyer to work for you.

What Is a Herniated Disc?

A herniated disc occurs when the material between the bones of the spinal cord ruptures or dislocates. These discs separate each bone in the spine (the vertebrae), providing a cushion between them so people are able to move and walk comfortably. These discs consist of a soft inner material and a harder outer casing that protects the inner portion. If the outer casing ruptures or is damaged, the inner part can shift from its usual position, allowing bones to rub against each other and potentially pinch nerves.

Over the years, the discs in our spinal columns wear down and become brittle, increasing the risk of a herniation. In other cases, however, these injuries occur as a result of a serious accident, like a:

  • Car Accident: A common cause of spinal injury. The impact and forces in a collision can cause the spine to shift in violent ways, dislocating or rupturing a disc.
  • Slip-and-Fall: Although not as commonly as car accidents, falls can also cause herniated discs. This usually happens when someone falls backwards, which is not uncommon when walkways are covered in snow and ice during Denver’s winter months.
  • Sports Accident: Even with protective gear, playing sports can cause serious injuries. If someone is struck in the back or falls in an awkward manner, he or she can end up with a herniated disc.
  • Workplace Accident: Herniated discs also happen as a result of bending and picking up heavy objects. Workers in transportation, moving, and other industries might not be provided with proper safety equipment, making a dislocation more likely.

Who Is Liable for My Injuries?

Liability for a herniated disc comes down to negligence, so the nature of your accident plays a large part in determining this. In a vehicle collision, you have to consider the actions of other drivers, unsafe road conditions, and even improper maintenance of vehicles. If you suffer a herniated disc due to a slip-and-fall, you have to consider if someone else may have caused your fall. A business or homeowner may be liable, if they allowed a dangerous situation to remain rather than fixing it.
